1. Acceptance of Terms

Welcome to TheCodeholic. By accessing or using our platform at thecodeholic.com (the "Platform"), purchasing courses, or using any of our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree with these Terms, please do not use our Platform or services.

These Terms constitute a legally binding agreement between you and TheCodeholic (the "Company," "we," "us," or "our"), a business operated by Zura Sekhniashvili. We reserve the right to update these Terms at any time, and your continued use of the Platform constitutes acceptance of any changes.

2. Course Access and Enrollment

When you purchase a course on our Platform, you receive a non-exclusive, non-transferable license to access the course content for personal educational purposes. Unless otherwise specified:

  • Course access is granted for the lifetime of the course (as long as it remains available on our Platform)
  • You may access courses from any device using your account credentials
  • Course content may be updated or improved over time, and you will have access to these updates
  • We reserve the right to retire or remove courses with reasonable notice to enrolled students
  • One account per person - account sharing is prohibited

3. Permitted Use of Course Materials

Course materials include videos, written content, code examples, projects, and downloadable resources. You are permitted to:

  • Use code examples: Copy, modify, and use any code provided in courses for your personal or commercial projects
  • Build portfolio projects: Create and showcase projects based on course teachings in your portfolio
  • Learn and practice: Download materials for personal educational use and practice
  • Share your work: Publicly display projects you've created using knowledge gained from our courses

You are NOT permitted to:

  • Share, distribute, or resell course materials (videos, PDFs, complete projects) to others
  • Share your account credentials with others
  • Download and redistribute course videos or content on other platforms
  • Use course content to create competing educational products
  • Remove copyright notices or attribution from course materials
  • Use automated tools to scrape or download bulk content from the Platform

4. Intellectual Property Rights

All course content, including videos, text, graphics, code structure, and teaching methodology, is the intellectual property of TheCodeholic and is protected by copyright and trademark laws.

Your Code: Any code you write based on course teachings belongs to you. You own the projects you create, though the original course materials remain our property.

Code Examples: All code examples and starter projects provided in courses are licensed for your use as described in Section 3.

5. Payment and Refunds

Pricing: All prices are listed in USD unless otherwise stated. We reserve the right to change prices at any time, but changes will not affect purchases already made.

Refund Policy: Refund and cancellation rights are handled in accordance with Paddle's Invoiced Consumer Terms and applicable consumer law. We do not apply additional merchant-specific eligibility requirements beyond those terms.

To request a refund, contact our support team and we will process your request under Paddle's policy.

6. User Conduct and Account Security

You are responsible for maintaining the security of your account credentials. You agree to:

  • Provide accurate registration information
  • Keep your password confidential
  • Notify us immediately of any unauthorized account access
  • Not share your account with others
  • Not use the Platform for any illegal or unauthorized purpose

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or abuse the Platform.

7. Course Content and Accuracy

While we strive to provide accurate, up-to-date, and high-quality educational content, we make no guarantees regarding:

  • Specific learning outcomes or career results
  • Completeness or accuracy of all technical information (technologies evolve)
  • Compatibility of code examples with all future versions of frameworks or tools

Course content may contain technical errors or become outdated as technology evolves. We will make reasonable efforts to update courses, but cannot guarantee all content remains current.

8. Community and Support

We may provide community forums, Discord channels, or other communication tools for students. When using these services, you agree to:

  • Be respectful to other students and instructors
  • Not post spam, advertising, or promotional content
  • Not share course materials or copyrighted content
  • Not engage in harassment, hate speech, or abusive behavior

We reserve the right to moderate, remove content, or ban users who violate community guidelines.

9. Limitation of Liability

To the maximum extent permitted by law, TheCodeholic shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use or inability to use the Platform or course content
  • Any unauthorized access to or use of our servers
  • Any bugs, viruses, or other harmful code that may be transmitted to or through our Platform
  • Any errors or omissions in course content
  • Any third-party content or conduct on the Platform

Our total liability for any claims under these Terms is limited to the amount you paid for the course(s) in question, or $100 USD, whichever is less.

10. Disclaimer of Warranties

The Platform and all courses are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

  • The Platform will be uninterrupted, secure, or error-free
  • The courses will meet your specific learning needs or career goals
  • Any defects will be corrected
  • The Platform or courses are free from viruses or harmful components

11. Third-Party Services

Our Platform may contain links to third-party websites, services, or resources. We are not responsible for the content, privacy policies, or practices of any third-party sites. You access third-party services at your own risk.

12. Privacy and Data Protection

Your use of the Platform is also governed by our Privacy Policy. We collect and process personal data in accordance with applicable data protection laws, including GDPR for European users. Please review our Privacy Policy to understand how we handle your information.

13. Termination

We may terminate or suspend your access to the Platform immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination:

  • Your right to access courses will immediately cease
  • You must delete all downloaded course materials
  • Provisions that should survive termination (including intellectual property rights, disclaimers, and limitations of liability) will remain in effect

14. Modifications to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify users by email or through a prominent notice on the Platform. Your continued use of the Platform after changes take effect constitutes acceptance of the modified Terms.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Georgia (the country), without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Platform shall be resolved through:

  • First, good faith negotiations between the parties
  • If negotiations fail, binding arbitration in Tbilisi, Georgia
  • Both parties agree to waive the right to a jury trial

17. Severability

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TheCodeholic regarding your use of the Platform and supersede any prior agreements.
